Terms of Service

Pets on Q, Inc. and all parties endeavor to follow industry best practices, including full, fair and effective disclosures of material facts relating to our relationship with each other. By accepting any position and/or opportunity on a gig/production herein, you acknowledge and agree to the following terms:

1. The Animal List is a booking platform only, owned by Pets on Q, Inc.
2. You represent and warrant that you are twenty-one years of age, or older, and have the legal right to agree to these terms.
3. You hereby release Pets on Q, Inc. from all liability, loss, claims, suits or damages arising out of or in connection with said position and/or opportunity.
4. You acknowledge that Pets on Q, Inc. does not provide any insurance for you or your animal. Should you choose to accept a position on a gig/production or opportunity herein, it is up to you to ensure that you have the proper insurance(s) in place to protect you, your animal and anyone your animal could potentially harm or injure while creating content, traveling to location, while on location, or traveling home from location, or otherwise working in any position, on any gig/production or opportunity, in any capacity, booked herein.
5. You acknowledge that Pets on Q, Inc. assumes no liability for any injury or stress, either physical or mental, that is incurred or caused by you, or your animal, while creating content, traveling to location, while on location, or traveling home from location, or otherwise working in any position, on any gig/production or opportunity, in any capacity, booked herein.
6. You hereby agree to uphold the highest standards of ethical behavior and treatment of your animal(s), and others, while working in any position, on any gig/production, in any capacity, booked herein.
7. You hereby agree to provide any requested certifications or licenses as required by the Brand/Client/Production. You hereby agree to utilize ethical standards and practices in the training of your animal and ensure that your animal is happy, healthy and ready to work when needed.
8. You hereby authorize and direct all Brands/Clients/Production to make all payments due and/or to become due hereunder to you in the name of Pets on Q, Inc., whose receipt shall constitute a full and lawful receipt by you. If an invoice is paid via a method that requires unforeseen payment processing fees (PayPal, credit card fees, etc…) those fees will be deducted from the amount paid to you.
9. You acknowledge that all transactions are subject to a processing fee that will be a minimum of 5% and Pets on Q, Inc. is compensated by retaining a portion of the agreed-upon fee paid by the Brand/Client/Production, the amount of which varies with each collaboration. All payments shall be made to talent via direct deposit once full payment is received by the Brand/Client/Production on the Pets on Q, Inc. payment schedule, which is currently once per month, on the first of the month, for all invoices paid the month prior for influencer campaigns and once the job is completed for set work.
10. You further acknowledge that you shall be responsible for any withholdings, taxes, agency and/or other fees due on and/or in connection with such total compensation payable herein. All parties agree that client's/Production's only requirement in relation to the fee is to make payment to Pets on Q, Inc. and that you will look solely to Pets on Q, Inc. for any fee to be paid to you. You are solely responsible for, and will file on a timely basis, all tax returns and payments required to be filed with, or made to, any federal, state or local tax authority with respect to the performance of any services for gig/production, in any capacity booked herein, and receipt of fees under these Terms and will hold Pets on Q, Inc. harmless from and against any tax liability associated with fees hereunder
11. You hereby agree to thoroughly review any contracts required by the Brand/Client/Production and address any questions or concerns immediately. Upon having all questions satisfied, you further agree to sign said contract(s), complete any start paperwork and sign any talent release form(s) required by the Brand/Client/Production accurately and in a timely fashion.
12. You hereby agree to provide any requested certifications or licenses as required by the Brand/Client/Production. You hereby agree to utilize ethical standards and practices in the training of your animal and ensure that your animal is happy, healthy and ready to work when needed.
13. You hereby agree that you will respect the intellectual property rights of others, including, without limitation, copyrighted material, trademarks and logos, and trade secret rights, as well as rights of publicity, including the right to use another’s name, likeness, image, voice or other indicia of identity. If you are required to post content on any platform, in any capacity, you may not post or share any content that incorporates any of these elements without first obtaining written permission to do so from the rights holder.
14. If you are required to post content on any platform, in any capacity, you hereby agree that you will clearly disclose your “material connections” with Brand/Client/Production, (i.e. the fact that your post is “sponsored by Client”) and you must include any hashtags requested by Pets on Q, Inc. or Brand/Client/Production (such as #ad or #sponsored). Pets on Q, Inc. may provide recommendations and options for disclosures, Pets on Q, Inc. is not responsible for any failure by you to comply with the FTC Guides or any failure by you to obtain all third-party clearances and permissions with respect to content you post.
15. You hereby acknowledge that no license or other right of any kind is granted by Pets on Q, Inc. or Brand/Client/Production to you, except as expressly provided in these Terms. You shall not use Pets on Q, Inc.’s copyrights, trademarks, trade names, or other intellectual property in any way except to the limited extent as may be expressly agreed to in a specific gig/production booked herein.
16. You hereby acknowledge that joining The Animal List as an Influencer or Content Creator is a non-exclusive relationship, unless specifically contracted otherwise.
17. You hereby acknowledge that joining The Animal List as a Wrangler and/or Animal Actor is an exclusive relationship and you further agree that you will not join any other online booking platforms for the purpose of booking set and print work.
18. You hereby acknowledge that relationship with Pets on Q, Inc. is that of an independent contractor, and nothing in these Terms is intended to, or should be construed to, create a partnership, agency, joint venture or employment relationship. You further acknowledge you will not be entitled to any of the benefits that Pets on Q, Inc. may make available to its employees, and you are not authorized to make any representation, contract, or commitment on behalf of Pets on Q, Inc.
19. You hereby agree to hold all Confidential Information in strict confidence, not to disclose Confidential Information to any third parties, and to use Confidential Information solely for the purpose of fulfilling its obligations under these Terms. “Confidential Information” shall mean all information, excluding information available from the public domain, disclosed by Pets on Q, Inc. or Brand/Client/Production to you related to these Terms, andy gig/production booked herein, or the current, future, and proposed business, products, and services of Pets on Q, Inc.
20. You hereby acknowledge and agree that Pets on Q, Inc.’s relationships with its customers, including Brands, Clients, Production companies, agencies and any other entities that use Pets on Q, Inc.’s services (“Customers”) are of great value to Pets on Q, Inc. Accordingly, you agree that during the term of your relationship with Pets on Q, Inc., and for one (1) year thereafter, you will not directly or indirectly solicit or engage any Customer to purchase services similar to those provided by Pets on Q, other than through Pets on Q, Inc.
21. Either party may terminate these Terms and/or the Services immediately in the event of a material breach by either party. Pets on Q, Inc. may terminate these Terms and/or the Services immediately for any reason at any time.
22. You acknowledge and agree that by signing up to be a part of The Animal List and talent roster, you agree to allow Pets On Q, Inc., and it’s affiliates, a worldwide, non-exclusive right to promote and utilize your social media content, pages, analytics and demographics as we see fit. This includes, but is not limited to, sharing of content, pricing and analytical data with potential clients (i.e. brands, marketing companies, production, etc.) and reposting of any social media content from any of the your social media pages/blogs, YouTube accounts, etc. across all platforms, websites, marketing materials and fast channels owned by, or affiliated with, Pets on Q, Inc., in any media, for any purpose. Pets on Q, Inc. reserves the right to modify your content based on best practices and industry style guides. We’d love to share your amazing content. However, if you ever wish to opt out of sharing, simply fill out this form, HERE, and we will respect your choice. You can use the same form to be removed from the roster at any time as well.
23. You hereby agree that you will not hold Pets on Q, Inc. or Brand/Client/Production, or their respective licensees, responsible for any liability resulting from use of your Content in accordance with the terms hereof. Pets on Q, Inc. and Brand/Client/Production shall not be liable for any indirect, consequential, exemplary damages (including but not limited to lost profits) and the combined, aggregate liability of Pets on Q, Inc. and Brand/Client/Production hereunder shall not exceed the fees payable to you under the the booked gig/production.
24. These Terms shall be governed in all respects by the laws of the State of California and you agree that unless otherwise indicated by Pets on Q, Inc. any action arising from or relating to these Terms shall be brought exclusively in a state or federal court located in Los Angeles County, California.
